There is plenty of opportunity for Amazon to not make the series a fan-fiction work, as Tolkien wrote a plethora of stories about and generally fleshed out the history of his universe. However, they probably will decide to do so, if only to give their writers maximum creative freedom, similar to the current situation of Star Wars (though very different in that while Disney changed the canon of Star Wars, naturally there can be no changes to the canon of LotR).
