Ok I was trying to sell on ebay for the first time, a Cade Skywalker BH mini. I said in the description that it didn’t come with a card. But after I promptly shipped the mini to him, he said it was “useless” without the card. After explaining that that I had clearly said this in the auction, he replied “MY MISTAKE IS APPARENTLY YOUR GAIN” in all caps. Should I refund immediately, so he doesn’t open a case (and probably win) or should I stand my ground? Please help.

You did nothing wrong. You told him there was no card, it's his own fault for not reading that. I make sure every time when I buy a mini that it says it comes with the card, and if it doesn't, I message the Seller and ask. So stand your ground, and if he opens a dispute, he'll lose.

Besides, was he really expecting to get a complete Cade for $8? Pfft. RollEyes

if you're able to prove that you mentioned that there is no card within the product description, there should be no reason why he would win the case. either it was his fault for not reading the description completely or he just wants to start something if he did.

i say, if you have proof, stay firm and stand your grounds. he even said it himself, "my mistake...". it was his responsibility to read before clicking on an impulse because it was some "super awesome" SW mini.

Oh, and the NO CARD a little lower down.

Dont even bicker with him. You did everything you needed to. Dont message him back or waste your time. If he wants to start something just let him and show that you stated what you did.

It is the Fault of the Buyer. Since it was clearly stated the figure came with no card.
I will say that I was a victim a few years ago of my own stupidity at not reading a description carefully. I bought a figure with no card. All I had to do was go back and look at the description. It's a lesson learned.

I would say stand your ground - but did he complete the transaction with paypal? If so, you are boned - even if you are 10,000,000% in the right. Paypal will find in the favor of the buyer if a mouse farts on mars during the transaction. If you have money in your paypal account, pull it out at once and when your money is secure, then and only then do you tell this guy to pound sand.

I have never had problems as a seller (except for somebody who contacted me for me to lower shipping on a single item she won (so it wasn't a combined shipping issue)), but as a buyer I've had to file a few claims. I'd see if there's any way you could report him right now, I'd do it. He lost his privelege to be listened to a negotiated with when he went all caps, IMO. How will jacka$$es like that ever learn to read the whole thing if they keep getting left off the hook for their inability or unwillingness to be a critical consumer.

Agreed...when the auction specifically states there is no card.

However, there is a flip side to this: sellers only showing a mini and not stating it does not come with a card.

This happened to me a couple years ago when I bought an IG-88 BH via Ebay auction. It showed up...with no card. I got back on Ebay and reread the auction for the 10th time and no where did it state the card was NOT included. However, it did not specify it came with a card either. I took it to Ebay and they said the auction is for what is shown in the picture and what is listed. I argued that the product, when not specified, is for a miniature AND the corresponding card. However, since the auction did not specify a card WAS included, and the picture did not show the card, I was out of luck.

So beware of any auction that does not show the MINI and the CARD in the picture. And always read the auction carefully.

ok so we pretty much all agree that it was the buyer's fault. now the question becomes: what is the chance that the ebay and paypal will see things his way, because of course it is impossible for a buyer to do any wrong on ebay.SneakyMad Confused Cursing
if i refund him, at least he wont open a case against me and possibly give me positive feedback.
if ive got the facts on my side, and he's got "the customer's always right" on his side, who would win if he opened a case against me? oh and i just found out i can only give him positive feedback.

I might have missed this, but what is your return policy as listed on ebay?

Actually, Ebay would side with you since your auction specifically stated there was no card supplied. End of story.

NVM, you have no returns listed, which is totally cool, as long as you lived up to your end of the deal.

I would message him saying something like this.

I am sorry, but we entered a contract when you bid. You need to be more careful to read descriptions of items before you bid. The item arrived as I described it. I do not mean offense, but the blame is 100% on you. I don't think it is worth your time or mine to continue this. It is unfair to expect me to go through all the effort to resell this item just because your bid won the item from someone who actually took the time to read the description. Hopefully you will learn to be more critical of the items on which you bid. I'm sorry you might feel cheated, but I lived up to my end of the deal 100%. Although it might seem unfair, the best thing to do is for both of us to leave each other positive feedback and move on.

This is a little too harsh. When dealing with upset customers in writing you need to be absolutely professional so they have nothing to use against you. Not knowing the privet exchange you have had till now I would respond somthing like this:

Thank you for contacting me. I understand that you are disappointed about not receiving a card with the purchase of Cade Skywalker, Bounty Hunter, but the auction clearly indicated that there was no card and presented the stats as an alternative. Since it appears that you are not happy with the written stats, I have taken the time to locate a card scan on-line. You can download and print it here: http://www.rebelscum.com/photo.asp?image=SWmini/SWminiLOTF40cadecardfr.jpg.

Since you agreed to the sail per the eBay contractual guide lines when you confirmed your bid, and the item you received is per the description of sail item 140498815311, I will not be issuing a refund and returns are not accepted.
