Character has the 'intuintion' and 'mercenary' special abilities. Can he use intuition if he has line of sight to an enemy or does the mercenary rules interfere with this ability?

Yes, he can use Intuition as he cannot make an attack when using Intuition, so Mercenary does not go into effect.
