When you are setting up your squad. The rules say you must be within four squares of the back edge of your side of the map. So can you be in a fifth square because that square is occupying the top of the fourth square? The way it is worded makes me think that you can be in a fifth square.
When playing a character that has encampment like Emperor on Throne it says you can put them anywhere on your half of the map, but the rules say you must be within four of the back part of your side of the map. I assume that encampment is allowed to break this rule?

Yes, emplacement is an exception to the set-up rule.
As for your first question, I don't know what you mean by "occupying" the fourth square. Small and medium figures must be entirely within the back four rows. If you have a large or huge figure (whose base takes up more than one square), you just need to have part of the base within the back four rows.
